Terms of service

Version 1.0 · These terms are a working draft containing placeholders and must be finalised before commercial deployment (see the deployment checklist).

1. Who we are

2. The service

Perspica provides self-paced online course modules, applied case files, timed assessments and, on successful completion of a certificate tier, a digital certificate with a public verification page. Access is personal to the registered account holder and may not be shared, resold or made available to any other person.

3. Accounts

You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account. We may suspend or close an account used in breach of these terms, including any attempt to share paid content, to circumvent assessment controls, or to misrepresent a certificate.

4. Purchases and pricing

Prices are stated in South African rand and include value-added tax. Payment is processed by Payfast; we do not store card details. Access to purchased content is granted once the payment is confirmed by the payment processor. The products currently offered are the Core Certificate (R1 950), the Professional Certificate (R3 750) and the Upgrade to Professional (R1 950).

5. Refunds

Refunds are governed by our refund policy, which forms part of these terms and reflects the cooling-off provisions of the Electronic Communications and Transactions Act 25 of 2002 to the extent they apply.

6. Assessments and certificates

Assessments are timed and scored, with a stated pass mark, a limited number of attempts and a reflection period between attempts. Certificates are issued on satisfaction of the published requirements, remain our property as credential issuer, and may be revoked where an assessment was compromised or a certificate is misrepresented. Certificate validity can be confirmed by anyone on the verification page.

7. Intellectual property

All course content, including lessons, case files, assessments and reading guidance, is protected by copyright and related rights. You receive a personal, non-transferable licence to use the content for your own learning. Reproduction, distribution, scraping or use of the content to train machine-learning systems is prohibited without written permission.

8. Educational content only

Course content is educational. It is general information and does not constitute legal, financial, regulatory or professional advice, and it does not create a professional relationship with us. Decisions affecting your institution should be taken on appropriate professional advice.

9. Availability and changes

We aim for continuous availability but do not guarantee it. We may update course content to keep it current; material changes to a certificate’s requirements will not be applied retrospectively to certificates already issued.

10. Liability

To the extent permitted by law, and without excluding liability that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008, our aggregate liability arising from the service is limited to the amount you paid for the affected product.

11. Privacy

Personal information is processed in accordance with our privacy notice, which explains our practices under the Protection of Personal Information Act 4 of 2013.

12. General

These terms are governed by South African law. If any provision is unenforceable, the remainder stands. We may amend these terms on reasonable notice; continued use after the effective date constitutes acceptance.
